Appeal of Denied Claims for Social Security Disability

Baton Rouge Social Security Disability Attorneys
We Prepare You for Your Disability Hearing

If you have been turned down for Social Security Disability, take heart. You may not know that first-time claims are routinely denied. The rejection rate is as high as 90 percent for many impairments.

Gordon McKernan and McKernan Law Firm have a very good success rate with appeals for Social Security Disability (SSD) and Supplemental Security Income (SSI). We know what it takes to win benefits and we know what it would mean for you to lose your appeal. Our lawyers put great time and energy into fighting for every client.

Based in Baton Rouge, we represent people in Lake Charles, Lafayette, New Orleans and across Louisiana who cannot sustain work because of a physical or mental disability. Contact us online or toll free at 877-247-3310 for a free initial consultation.

The Social Security Disability Appeals Process

We can't speed up the Social Security Administration (SSA), but we are confident we can greatly improve your chances of success if you applied for benefits and received a Notice of Denial.

Under a pilot program in Louisiana, the SSA has eliminated Reconsideration (which takes several months and usually results in denial). Instead, your case goes straight to a disability hearing.

You will appear before an administrative law judge (ALJ) to testify in person why your disabling condition prevents you from working. Unlike the big national law firms that send a lawyer at the last minute, we take the time to explain the process, allay your fears and prepare you for the questions the judge is likely to ask. Our attorneys personally handle your case and accompany you to your ALJ hearing. We spends hours reviewing your medical records to give you the highest chance of winning.

Why Was Your Claim Denied?

The SSA almost automatically denies initial claims. We review your application and the Notice of Denial to find out what's missing. It may be incomplete forms or incorrect information. You may need additional documentation from doctors to meet the listed criteria for a qualifying impairment. We fill in the holes and arrange a hearing.

Mr. Tilly is knowledgeable about alternative "grid rules" for qualifying if your case does not fit the criteria. For example, if you are over 50, or have no diploma or marketable skills, we make sure the ALJ judge takes that into consideration.
