More Than Half Dozen People Hospitalized From School Bus Accident

I understand that many of the students involved in the school bus accident in LaPlace have returned to school. Last week, 21 students from Lake Pontchartrain Elementary and Middle School were on their way home after school when an 18-wheeler crashed into their bus injuring the bus driver and six students. Four of the students were taken by ambulance to the hospital with moderate injuries.

State Police do not think that alcohol was a factor in the accident, but the truck driver has been charged with careless operation and negligent injury.

Did you know that studies have concluded that large trucks are nearly twice as likely as passenger vehicles to be involved in multi-vehicle crashes? What's more, nearly 25 percent of fatal accidents involve a large truck, even though they represent a mere three percent of all registered vehicles. I believe that many of these crashes are the result of a preventable problem - truck driver fatigue.

If you are injured in a truck accident caused by a fatigued truck driver, you will want an attorney with the experience and know how to successfully represent you against Big Truck Insurance Companies. If you have been hurt in an accident we can take on the insurance companies and help you get full and fair compensation for your pain and suffering. If you have been hurt, let me help you.

Research Shows Speed Limiters Provide Truck Safety Benefits

Louisiana drivers should be happy to learn that new research by the Federal Motor Carrier Safety Association show significant safety benefits from technology that electronically controls the speed of commercial trucks.

For years, the American Trucking Association's (ATA) research has found that speed is a major factor in fatal accidents involving 18-wheelers. According to the ATA, encouraging vehicle drivers to slow down is one of the most effective ways to prevent accidents on the nation's highways. Speed limiter technology may help combat safety problems and reduce the number of truck accidents pointed out by the ATA.

Trucking Businesses Struggle To Develop Effective Distracted Driving Policies

Many businesses are aware of the risks posed by their drivers having an accident. A recent change to federal rules governing commercial drivers has increased that risk.

The Federal Motor Carrier Safety Administration (FMCSA) issued a new regulation, which became effective on Jan. 3, banning commercial truck drivers from using handheld cell phones.

The regulations define a commercial vehicle as:

  • Over 10,000 lbs that crosses state lines
  • Any vehicle over 26,000 lbs

Serious Truck Accident Near New Orleans Causes Chemical Spill

Statistics taken from the National Traffic Safety Administration's website show that tens of thousands of people are killed in motor vehicle accidents every year, while many more are injured. Historically, a small percentage of these accidents involve 18-wheelers, but the consequences to drivers and passengers when involved in an accident with a semi-truck can be severe.

A recent crash in East Baton Rouge County Louisiana highlights these dangers.

A driver from Florida missed his exit and backed up on the freeway in order to take it. When he backed up, an 18-wheeler struck him from behind. The accident shut down a portion of the freeway for several hours. The driver of the big rig, the vehicle driver and his passenger were all injured and taken to an area hospital.

The semi-truck was in route from an Exxon refinery with a trailer full of corrosive chemical waste when the crash occurred. The force of the impact caused the tractor-trailer to spill the contents onto the roadway. Although, the chemical did not pose an inhalation risk, clean-up crews wearing hazmat suits were required to remove the corrosive chemicals seeping from the truck.

Two Die From Injuries Resulting From 18-wheeler Accident

KENTWOOD - Two women were killed and two were injured when an 18-wheeler driven by Stennis Taylor, 50, of Magnolia, Miss., broadsided their Lincoln LS sedan which was stopped in the eastbound lane of LA 38, attempting to turn left into a private drive. The wreck happened at about 6 p.m. on La. 38, east of Kentwood in Tangipahoa Parish.

According to news reports, the truck driver did not see that the Lincoln in front of him was stopped and when Taylor recognized the situation, he tried to pass the car on the left to avoid a rear-end crash, but as he turned the 18-wheeler into the westbound lane, the Lincoln started turning left and the truck plowed into the car's left side.

Will New Hours-of-Service Rules Reduce Trucking Accidents?

The Obama administration ruled that truck drivers cannot work more than 11 hours per day, among other hours-of-service (HOS) changes, in an attempt to improve safety and reduce 18-wheeler accidents. But the revisions could have an adverse effect on truck drivers and passenger vehicles, a concerned American Trucking Association (ATA) reports.

Under the new law, truck drivers are much more restricted in when and how they allocate hours. For instance, drivers must take at least a 30 minute break during an eight hour stretch if they are to continue working up to their 11 hours. Overall, truck drivers are now limited to 70 hour workweeks.

Sleep Apnea May be Leading to Fatigued Truck Driving Accidents

In recent years, the Federal Motor Carrier Safety Administration (FMCSA) has begun to find ways to combat fatigued driving, including proposing changes to the hours of service (HOS) rules pertaining to the number of hours that truck drivers can spend behind the wheel. One of the causes of fatigued driving that is beginning to garner attention is sleep apnea.

Sleep apnea is a condition in which the upper airway constricts during sleep and causes the sleeper to be unable to take full breaths or pauses in breathing. Sleep apnea, when not treated, results in people's sleep to be disturbed leaving them tired the next day, even if they receive a "full" night's sleep. However, it should be noted, that when caught, sleep apnea can be effectively treated with a sleep machine that helps people breathe while sleeping.

Study Highlights Commercial Truck Accidents and Safety Risks

They are the ever-present goliaths hauling cargo and traversing America's highways, semi trucks. While these large trucks play a nearly indispensable role in distributing products, they also pose a safety risk to other, smaller vehicles. And, when 18-wheeler accidents occur - because of the sheer size of the trucks - the consequences for the drivers and passengers of the other vehicles can be devastating.

The Federal Motor Carrier Safety Administration (FMCSA) and the National Highway Traffic Safety Administration (NHTSA) studied approximately 1,000 vehicle accidents occurring between spring 2001 and winter 2003 involving large trucks that resulted in injuries and fatalities. Called the Large Truck Crash Causation Study (LTCCS), researchers used the considerable amount of data collected to identify the causes and contributing factors to the accidents and then formulate 10 critical safety issues that need to be addressed.

Fatigued Truck Drivers Pose a Major Threat

Semi-truck accidents are a major problem in the United States. As Baton Rouge truck accident attorneys know all too well, large trucks are nearly twice as likely as passenger vehicles to be involved in multi-vehicle crashes. What's more, nearly 25 percent of fatal accidents involve a large truck, even though they represent a mere three percent of all registered vehicles.

All told, truck accidents kill over 5,000 Americans every year and cause an additional 150,000 to suffer personal injury.

Many of these crashes are the result of a preventable problem - truck driver fatigue. According to the National Highway Transportation Safety Administration, truck driver fatigue is a factor in almost 40 percent of truck accidents. In one survey, 28 percent of truck drivers admitted to falling asleep behind the wheel at some point during the previous month.

The chances that a truck driver will be involved in an accident doubles between the eight and tenth driving hour. It doubles again between hours ten and eleven.

NTSB: States Should Ban Truckers From Using Cell Phones

The most recent message from the National Transportation Safety Board (NTSB) is that states should prohibit truckers and other commercial drivers from using cell phones while driving.

The NTSB recently made a nonbinding recommendation to prohibit such drivers from using both handheld and hands-free phones, except in an emergency. "The NTSB firmly believes that commercial drivers must focus their attention on operating their large, heavy commercial vehicles rather than switching their attention between driving tasks and telephone use," the board said.
